These terms set out the basis on which Kelena provides interior design services. By engaging Kelena — whether through this website, by phone, by email, or in person — you agree to the terms below. Please read them before proceeding.
1. About Kelena
Kelena is an interior design studio based in Damansara Jaya, Petaling Jaya, Selangor, Malaysia. The studio offers concept direction, design documentation, and sourcing services for residential interiors. Kelena operates within the scope of non-regulated interior design practice and does not offer services reserved for licensed professionals in architecture, structural engineering, or building services.
2. Services Offered
Kelena currently offers three engagements:
- Eclectic-Direction Concept Brief (RM 460): A direction-setting engagement producing a written brief, visual direction document, and draft layout for clients with an existing collection of pieces.
- Detailed Eclectic-Style Documentation (RM 3,150): Full interior documentation including layout, joinery, lighting, finishes, and 3D views, with two revision rounds and a reasoning note for each significant choice.
- Sourcing and Curated Adds (RM 1,580): Sourcing of additions across two budget bands, with a placement visit on installation day, suited to clients seeking thoughtful continuation rather than a complete redesign.
The scope of each service is confirmed in writing prior to commencement. Any work outside the agreed scope requires a separate arrangement.
3. Engagement and Confirmation
An engagement begins when both parties have agreed on the scope of work and Kelena has confirmed the engagement in writing (by email or message). Submission of an enquiry form does not constitute a confirmed engagement. Kelena reserves the right to decline any enquiry at its discretion, without obligation to provide reasons.
4. Fees and Payment
- All fees are stated in Malaysian Ringgit (RM) and are inclusive of Malaysian service tax where applicable at the time of invoicing.
- A deposit of 50% of the agreed fee is due before work commences, unless otherwise agreed in writing.
- The remaining balance is due upon delivery of the final output, or as otherwise specified in the engagement confirmation.
- Fees are non-refundable once work on that stage has commenced, except where Kelena is unable to complete the agreed work.
- Late payments may result in a pause in work until the outstanding amount is settled.
5. Revisions and Changes
Revision entitlements are as specified per service: the Detailed Eclectic-Style Documentation includes two revision rounds; the Concept Brief and Sourcing services do not include structured revision rounds unless otherwise agreed. Additional revisions outside the included scope are chargeable at an hourly rate to be agreed in advance.
A revision is defined as a request to modify work already presented, within the original scope. Requests that materially change the brief or introduce new direction constitute a change of scope and are handled separately.
6. Client Responsibilities
- Providing accurate information about the space, existing pieces, and project requirements in a timely manner.
- Making decisions and providing approvals within a reasonable timeframe to allow the work to proceed.
- Arranging access to the property where required for site visits or placement visits.
- Ensuring that any works carried out by contractors or tradespeople are done so in compliance with applicable Malaysian building regulations. Kelena's design documentation does not substitute for structural, electrical, or plumbing approvals from licensed professionals.
7. Intellectual Property
All drawings, documents, visual presentations, and written materials produced by Kelena remain the intellectual property of Kelena until full payment has been received. Upon receipt of full payment, the client receives a licence to use the deliverables for the specific project for which they were created.
Kelena retains the right to use images of completed work in its portfolio, on this website, and in promotional materials, unless the client requests otherwise in writing before the engagement concludes.
8. Sourcing and Third-Party Products
Where Kelena sources or recommends products, furnishings, or materials on behalf of a client, those items are subject to the terms and conditions of the relevant suppliers. Kelena does not act as a retailer and does not hold stock. Availability, lead times, and pricing are subject to change and are confirmed at the time of sourcing.
Kelena is not responsible for defects, delays, or damages arising from third-party suppliers or tradespeople engaged independently by the client.
9. Limitation of Liability
Kelena's liability in connection with any engagement is limited to the fee paid for that engagement. Kelena is not liable for indirect or consequential loss, loss of enjoyment, or costs arising from contractor errors, supplier delays, or changes in the client's circumstances after the engagement has commenced.
Nothing in these terms limits liability for fraud, personal injury, or any matter that cannot be excluded under Malaysian law.
10. Cancellation
If a client wishes to cancel an engagement after work has commenced, they remain liable for payment of all work completed to that point, including the deposit where applicable. Cancellation requests should be made in writing to the studio.
Kelena may cancel an engagement if the client fails to meet their responsibilities under these terms, including failure to pay on time or to provide necessary information. In such cases, fees for work completed to date remain payable.
11. Confidentiality
Both parties agree to treat each other's confidential information with discretion. Kelena will not share client project details, home addresses, or personal information with third parties except as required to carry out the agreed work (for example, sharing a floor plan with a furniture supplier), or as required by law.
12. Governing Law
These terms are governed by the laws of Malaysia. Any disputes arising from an engagement with Kelena will be subject to the jurisdiction of the Malaysian courts, with both parties agreeing to seek resolution in good faith before initiating formal proceedings.
13. Changes to These Terms
Kelena may update these terms from time to time. The current version will always be available on this page. Engagements are governed by the terms in effect at the time of engagement confirmation.
